  1. 역주1 刑賞忠厚之至: 이 글은 嘉祐 2년(1057)에 실시된 進士科에 蘇軾이 제출한 답안인데, 이때 蘇軾은 次席으로 급제하였다. 蘇轍의 〈東坡先生墓誌銘〉에 의하면 당시 禮部侍郞이던 歐陽脩가 知貢擧(과거시험위원장)의 직책을 맡았는데, 그는 평소 당시에 유행하던 수사만 화려한 騈儷體의 문장을 배척하고, 典雅하고 간결한 古文을 숭상하였다. 함께 고시관으로 있던 梅聖兪(梅堯臣)가 蘇軾의 이 글을 보여주자, 歐陽脩는 뛰어난 문장과 논리에 감탄하여 수석으로 登第시키려 하다가, 혹 자신의 제자인 曾鞏의 작품이 아닌가 하여 次席으로 낮추었다고 한다.

  8. 역주8 書曰……寧失不經: ‘不經’은 형벌을 정상적으로 시행하지 못하는 것으로, ‘寧失不經’은 죄가 없는 사람을 처벌하기보다는 차라리 죄인을 풀어주어, 마땅히 형벌해야 할 죄인을 정상적으로 형벌하지 못하는 실수를 범하는 것이 낫다는 뜻이다. 《書經》 〈虞書 大禹謨〉에 “舜임금의 德은 잘못됨이 없으시어 아랫사람들에게 간략함으로써 임하고 무리들을 너그러움으로써 어거(통제)하시며, 罰은 자식에게 미치지 않고 賞은 자손 대대로 미치게 하시며, 과오로 지은 죄는 용서하여 크게 형벌함이 없고 고의로 지은 죄는 형벌하여 작게 처벌함이 없으시며, 罪가 의심스러운 경우에는 가벼운 쪽을 따르고 功이 의심스러운 경우에는 무거운 쪽을 따르며, 죄 없는 사람을 죽이기보다는 차라리 정상적인 법대로 처벌하지 않은 실수를 범하겠다고 하시어 살려주기를 좋아하는 德이 민심에 흡족하십니다. 이 때문에 백성들이 有司를 범하지 않는 것입니다.[帝德罔愆 臨下以簡 御衆以寬 罰弗及嗣 賞延于世 宥過無大 刑故無小 罪疑惟輕 功疑惟重 與其殺不辜 寧失不經 好生之德 洽于民心 玆用不犯于有司]”라고 보인다.
